6、ry. （11）裝運(yùn)嘜頭：（11）Shipping Marks：其他條款：OTHER TERMS：1. 異議：品質(zhì)異議須于貨到目的口岸之日起 30天內(nèi)提出，數(shù)量異議須于貨到目的口岸之日起 15 天內(nèi)提出，但均須提供經(jīng)賣方同意的公證行的檢驗(yàn)證明。如責(zé)任屬于賣方者，賣方于收到異議 20天內(nèi)答復(fù)買方并提出處理意見。1. Discrepancy：In case of quality discrepancy, claim should be lodged by the Buyers within 30 days after the arrival of the goods at the port of

7、destination, while for quantity discrepancy, claim should be lodged by the Buyers within 15 days after the arrival of the goods at the port of destination. In all cases, claims must be accompanied by Survey Reports of Recognized PublicSurveyors agreed to by the Sellers. Should the responsibility of

8、the subject under claim be found to rest on the part of the Sellers, the Sellers shall, within 20 days after receipt of the claim, send their reply to the Buyers together with suggestion for settlement. 2. 信用證內(nèi)應(yīng)明確規(guī)定賣方有權(quán)可多裝或少裝所注明的百分?jǐn)?shù)，并按實(shí)際裝運(yùn)數(shù)量議付。（信用證之金額按本售貨合約金額增加相應(yīng)的百分?jǐn)?shù)。） 2. 9、it shall stipulate the Sellerss option of shipping the indicated percentage more or less than the quantity hereby contracted and be negotiated for the amount covering the value of quantity actually shipped. (The Buyers are requested to establish the L/C in amount with the indicated percentage over t

10、he total value of the order as per this Sales Contract.) 3. 信用證內(nèi)容須嚴(yán)格符合本售貨合約的規(guī)定，否則修改信用證的費(fèi)用由買方負(fù)擔(dān)，賣方并不負(fù)因修改信用證而延誤裝運(yùn)的責(zé)任，并保留因此而發(fā)生的一切損失的索賠權(quán)。3. The contents of the covering Letter of Credit shall be in strict conformity with the stipulations of the Sales Contract. In case of any variation there of necessita

11、ting amendment of the L/C, the Buyers shall bear the expenses for effecting the amendment. The Sellers shall not be held responsible for possible delay of shipment resulting from awaiting the amendment of the L/C and reserve the right to claim from the Buyers for the losses resulting therefrom. 4. 除

12、經(jīng)約定保險(xiǎn)歸買方投保者外，由賣方向中國的保險(xiǎn)公司投保。如買方需增加保險(xiǎn)額及/或需加保其他險(xiǎn)，可于裝船前提出，經(jīng)賣方同意后代為投保，其費(fèi)用由買方負(fù)擔(dān)。4. Except in cases where the insurance is covered by the Buyers as arranged, insurance is to be covered by the Sellers with a Chinese insurance company. If insurance for additional amount and /or for other insurance terms is r

13、equired by the Buyers, prior notice to this effect must reach the Sellers before shipment and is subject to the Sellers agreement, and the extra insurance premium shall be for the Buyers account. 5. 因人力不可抗拒事故使賣方不能在本售貨合約規(guī)定期限內(nèi)交貨或不能交貨，賣方不負(fù)責(zé)任，但是賣方必須立即以電報(bào)通知買方。如果買方提出要求，賣方應(yīng)以掛號函向買方提供由中國國際貿(mào)易促進(jìn)委員會或有關(guān)機(jī)構(gòu)出具的證明，證

14、明事故的存在。買方不能領(lǐng)到進(jìn)口許可證，不能被認(rèn)為系屬人力不可抗拒范圍。 5. The Sellers shall not be held responsible if they fail, owing to Force Majeure cause or causes, to make delivery within the time stipulated in this Sales Contract or cannot deliver the goods. However, the Sellers shall inform immediately the Buyers by cable. Th

15、e Sellers shall deliver to the Buyers by registered letter, if it is requested by the Buyers, a certificate issued by the China Council for the Promotion of International Trade or by any competent authorities, attesting the existence of the said cause or causes. The Buyers failure to obtain the relative Import Licence is not to be treated as Force Majeure.6. 仲裁：凡因執(zhí)行本合約或有關(guān)本合約所發(fā)生的一切爭執(zhí)，雙方應(yīng)以友好方式協(xié)商解決；如果協(xié)商不能解決，應(yīng)提交中國國際經(jīng)濟(jì)貿(mào)易仲裁委員會，根據(jù)該會的仲裁規(guī)則進(jìn)行仲裁。仲裁裁決是終局的，對雙方都有約束力。6.
